All Pools Diversions Policy
CROPP recognizes the value of the local food movement and the opportunities it creates to form direct relationships between the farmer and the consumer. CROPP may allow individual members to sell products directly to consumers on a limited basis. All sales must be in accordance with state and federal regulations, and with the individual member's pool policies and guidelines. A member who markets products outside of the cooperative must comply with any additional requirements or procedures to protect the cooperative from any negative publicity or liability arising from the sale or use of the products. CROPP reserves the right to disallow a member to divert for any reason. Members who fail to comply with this policy, or the pool's policies, may have their membership terminated. Once a member has lost the right to divert product, it will not be reinstated without Board approval.
Dairy Pool Diversion Policy
The Cooperative relies on a consistent supply of milk from the dairy pool members to assure efficient operations, and to meet supply needs on a daily basis. Members pledge all of their dairy production to the Cooperative for marketing. For these reasons, diversions of milk are discouraged, however, the privilege to divert milk may be granted on a limited basis under the All Pools Diversions Policy and the following conditions:
- Engaging in the raw milk business prohibited.
- Diversions (e.g., for cheesemaking) must be pre-approved by the Dairy Executive Committee. Dairy Pool staff will also assure a process is in place to assure two week notice of bulk tank diversion to avoid hauling and production disruptions.
- Products from diversion may only be sold directly to consumers on the farm or at a farmer's market. Sales of products through a third party (ie., stores or group sales) are prohibited.
- Diversion of all or a part of the bulk tank for wholesale sales is prohibited;
- Members may not represent the products in any way as an Organic Valley® product and the Cooperative may take other steps to assure products are not associated with Organic Valley®.
